Giuffre suit highlights Dershowitz's shady actions throughout Epstein affair; Giuffre wants jury trial

Note: This is a court report detailing information presented in the complaint (amended) of Virginia L. Giuffre v. Alan Dershowitz, filed on April 15, 2020 in the Southern District of New York, as described in court documents obtained by the author.

It is confirmed in numerous court documents that the federal government has established that Jeffrey Epstein, Ghislaine Maxwell, and others are guilty of sexually assaulting and trafficking minors all over the world. Although Epstein is no longer here, Virginia Giuffre is seeking justice from some of Epstein's friends and/or associates to whom she was trafficked all over the world by the once extremely popular pedophile. Alan Dershowitz will be the first to answer some questions, maybe.

Dershowitz was ordered on June 19, 2020 by senior United States District Court Judge Loretta A. Preska to join a June 23, 2020 conference call for 2:00 p.m. in response to an April 15, 2020 complaint filed by Virginia Giuffre in the Southern District of New York. Dershowitz is being sued for defamation, battery, and violations of the Wiretap Act. Giuffre is seeking compensatory, consequential, exemplary, and punitive damages, demanding a trial by jury.

Dershowitz was one of the lawyers who took part in the unethical events that took place regarding the victims' rights under the Crime Victims Rights Act and the drafting of the September 24, 2007 non-prosecution agreement (NPA), giving Epstein and his co-conspirators, even potential co-conspirators, immunity from federal charges and prosecution unbeknownst to the victims. Two victims other than Giuffre challenged the NPA, citing CVRA violations on July 7, 2008. Before that, in 2005 when the state was ready to prosecute Epstein, Dershowitz came in and changed the direction the case was to take by using the victims' MySpace pages to discredit and shame them, according to a Palm Beach Post article by Jane Musgrave, John Pacenti and Lulu Ramadan.

Giuffre was added to the CVRA action in December of 2014, when attorneys Brad Edwards and Paul Cassell filed a Joinder Motion to add her testimony of Epstein's, Dershowitz's, Maxwell and others' abuses of her as a minor, as she had years before. Dershowitz claimed to have proof that Edwards and Cassell admitted the women were lying, which could have had them disbarred in filing that motion if found guilty. Edwards, an advocate for women and children, and Cassell, a former U. S. District Court judge, sued and received a settlement for defamation against Dershowitz in April of 2016 for an undisclosed amount. The settlement was an act on Dershowitz's behalf to avoid victims being heard, and he had the nerve to claim the settlement proved his innocence. Dershowitz's attack campaign was just beginning.

In 2014, Dershowitz accused lawyer David Boies of persuading the women to make accusations against him, going as far as to say Boies should be jailed and calling all parties involved criminals. Dershowitz accused Boies of subornation of perjury and extortion in his rampage, even claiming he had proof in the form of emails that Boies was a part of an extortion plot with the victims to get money from Les Wexner, Epstein's rumored former lover, posing as the pedophile's only investment client. Dershowitz illegally recorded Boies during a confidential settlement negotiation meeting in 2015, sharing out-of-context sound bites with the press, bringing about the Wiretap Act count. The meeting, per request by Dershowitz, was an opportunity for Dershowitz to suggest the victims had him confused with Nathan Myhrvold, former CTO for Microsoft. Dershowitz even concocted a statement suggesting what the victims could say (below).



In 2018, the Miami Herald published a detailed expose of what was happening with Epstein, minor girls, and the NPA that granted immunity to the child predator and any potential co-conspirators. The story gave Dershowitz cause to focus his attacks toward the victims.

Dershowitz's rampage

Beginning in November of 2018, in a Miami Herald interview, Dershowitz accused Giuffre of lying and extortion. Dershowitz went on to tell his story to any outlet that would listen, as often as he could. In letters in early December of 2018 Dershowitz called Giuffre a liar who wanted money, said he had never met her (Raw Story), and that she was framing him to get money from wealthy men, even claiming her own lawyers had acknowledged that Giuffre was lying (Miami Herald).

In Giuffre's current complaint against Dershowitz, he is accused of attacking Giuffre in order to damage her "reputation and credibility and to try to intimidate her into silence," according to the claim. Giuffre claims Dershowitz knew he had sex with her and he knew that there was no plot, but his attacks continued. He claimed the "FBI recognized the evidence showed he was not" present physically to abuse Giuffre in an interview for Law&Crime Network; he told The Harvard Crimson Giuffre made up her story to extort Wexner - these events all took place between Dec. 1st and Dec. 5th in 2018. On March 2, 2019, he took to Twitter, calling Giuffre and Sarah Ransome, who he was representing at the time he allegedly assaulted Giuffre, his "perjuring accusers."

In April of 2019, Dershowitz accused Giuffre of "hurting the Me Too movement" by being a "fake victim" to The Daily Mail. He claimed to have Giuffre on a recording telling her best friend that she was trying to get "a third of a billion dollars" from Wexner on The View on May 2, 2019. These claims can be seen in Dershowitz's Twitter feed. Turning back to Twitter on July 5, he continued to blast Giuffre and claim his innocence. Dershowitz blasted Giuffre on CBS This Morning on July 10th, on Fox News on July 12th, and on NPR on July 15th. He accused David Boies of causing the women to commit perjury against him on Newsmax TV on July 18th. Dershowitz was back at Fox News on July 19th, and in a New York Magazine article claiming to be a victim of perjury. July 26th and 29th, he was on Newsmax TV again blasting Boies and the accusers, saying they all belonged in jail.

Dershowitz returned to Twitter on August 9th, claiming unsealed court documents would exonerate him. On August 10th, Dershowitz told Fox News Giuffre was fantasizing about him by making her accusations and that her lawyers pressured her to lie in order to extort Wexner. Dershowitz went as far as to take on the victim role in his book, Guilt by Accusation: The Challenge of Proving Innocence in the Age of #MeToo, which he is currently offering for free on Kindle from his Twitter page. On August 12th in a press statement, on August 30th on Newsmax TV again, on October 19th back to Twitter, on November 16th on BBC Radio, on November 19th in his book, Dershowitz claims he is the victim, has been framed, and that the accusers are the real perpetrators, according to the amended complaint.

Dershowitz is not a quitter 

On December 8th he was back at Fox News sticking to his story about never having met Giuffre, having proof that she said she never met him, of her being persuaded by her lawyers to accuse him in 2014, as well as outlining the non-existent extortion plot against Wexner, for whom a complaint was never filed. Dershowitz even claimed he prevailed in the confidential settlement with Edwards and Cassell, and that the terms exonerated him of any wrongdoing, which was not the case. Dershowitz claimed he wanted a trial in order to establish his innocence, but settled the case that would have given him a trial, and failed to waive the statute of limitations in order to face a suit for sex abuse after he said he would do so. 

Damages

Giuffre, in 2015, founded Victims Refuse Silences in Florida the same month to help survivors of human trafficking. Dershowitz's actions, Giuffre claimed, caused "public hatred, contempt, ridicule, and disgrace," according to the complaint, and could discredit her in ways that could harm her efforts to help others victims of sex trafficking. Even the North American Man/Boy Love Association (NAMBLA; I refuse to link the website) blasted the minors as willing participants in an article available on their website written by Peter Herman in June. 

Knowing what he was saying was untrue, Dershowitz's defamation is considered malicious. In the April 15, 2020 complaint Giuffre accused the former friend and lawyer of Epstein of being one of her abusers and of participating in sex trafficking along with Epstein and Maxwell. Giuffre said Dershowitz's abuses took place on at least seven occasions from 2000 to 2002, including in New York. Included among the co-conspirators are Sarah Kellen (a.k.a. Sarah Kensington, Sarah Kellen Vickers, wife of NASCAR racer Brian Vickers), Adriana Ross, Lesley Groff, and Nadia Marinko[va].

Giuffre was trafficked all over the world, as seen in the map below, escaping in 2002 during a trip to Thailand, from where she was supposed to bring back a young girl for Epstein. Giuffre (then Roberts) escaped to Australia, where she met her husband. As late as December 2018, Dershowitz was still an attorney for Epstein. Giuffre claims Dershowitz raped her at the New York mansion on 71st Street, assaulting her just after Epstein finished assaulting her. She said Dershowitz had sex with her at least seven times. Dershowitz attempted to distance himself from Epstein and anyone else involved in this case in order to cover up his crimes and to discredit and intimidate Giuffre.

Dershowitz looks guilty

Dershowitz, like Epstein and Maxwell, did everything to avoid a reopened federal criminal investigation, but he admits receiving massages from the girls. "Massage" is a known code word for sex in trafficking circles. In January of 2015, Dershowitz told a local news station that he did not remove his underwear during his massage. Footage obtained by the FBI show Dershowitz lied about having seen naked pictures of minors throughout Epstein's New York home. He even denied representing Ransome. Testimony from Epstein's former employees, Juan Alessi and Alfredo Rodriguez (d), and Maria Farmer and Sarah Ransom confirmed Dershowitz frequented Epstein's properties.

Dershowitz took no accountability for his actions. Instead, he went on a rampage against the victims. Dershowitz was aware that because of his prestige, his libelous and slanderous statements would reach millions of people all over the world, and that he would be able to convince many people that he was being truthful about the women. This caused the victims much disgrace, "economic damage, psychological pain and suffering, mental anguish and emotional distress, and other direct and consequential damages and losses" according to the complaint. Dershowitz and others who may attempt to repeat his behavior in the case they are accused, must be stopped, according to Giuffre's complaint.The courts will decide, if Dershowitz does not settle as he has in the past.

One only has to think of Tom Hanks or Ellen DeGeneres these days - go to their Twitter pages - because what is happening with them is headline news. People are accusing them of some extremely serious crimes and presenting solid evidence. This is to point out the seriousness and urgency of researching topics of subjects or issues of importance rather than counting on getting information from the MSM. Current events that matter are more than likely not going to be shared on the local news or the national news networks.
